Terms of Service

Thank you for using Untilt! We built it to help you actually finish the articles you mean to read.

When we say "Company", "we", "our", or "us" in this document, we are referring to Delaney Labs LLC, the operator of Untilt.

When we say "Services", we mean the Untilt iOS and Android applications, the getuntilt.com website, and any related services we operate.

When we say "you" or "your", we are referring to the person who owns an Untilt account.

We may update these Terms of Service ("Terms") in the future. Whenever we make a significant change, we will refresh the date at the top of this page and take appropriate steps to notify account holders. When you use our Services, now or in the future, you are agreeing to the latest Terms. There may be times where we do not exercise or enforce a right or provision of the Terms; that does not mean we are waiving that right or provision. These Terms do contain a limitation of our liability.

Account terms

  1. You are responsible for maintaining the security of your account. You sign in with Apple or Google, so keeping those accounts secure keeps your Untilt account secure. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  2. You must be a human. Accounts registered by bots or other automated methods are not permitted.
  3. You must be at least 18 years old to use the Services.
  4. You are responsible for all content uploaded to and activity that occurs under your account.

Pricing

Untilt is currently free to use. We do not ask for your credit card, and just like everyone else who uses our Services, we do not sell your data. If we introduce paid features in the future, we will publish pricing and payment terms before charging anyone, and give existing users clear notice.

Acceptable use

  1. You may only upload content you have the right to record and process for your own personal use. Untilt is a personal reading tool: recordings of articles you are reading are processed to help you read them. You may not use the Services to republish, redistribute, or resell content belonging to others.
  2. You may not use the Services for any unlawful purpose, to infringe the rights of others, to distribute malware, or to attempt to gain unauthorized access to our systems or other users' accounts.
  3. Abuse or excessively frequent automated requests to the Services may result in the temporary or permanent suspension of your account.

Cancellation and termination

  1. You can delete your account at any time from the Account screen in the app. Deleting your account immediately removes your access, and your content is deleted as described in our Privacy Policy.
  2. We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time, including violation of these Terms. Termination will result in the deletion of your account and the forfeiture of all content in your account.
  3. Verbal, physical, written or other abuse (including threats of abuse or retribution) directed at anyone operating the Services will result in immediate account termination.

Modifications to the Services

We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice. We will do our best to give notice of significant changes, but as a free service we make no guarantee of continued availability of any feature.

Uptime, security, and privacy

  1. Your use of the Services is at your sole risk. We provide these Services on an "as is" and "as available" basis. We do not offer a service-level agreement, but we take the reliability of the Services seriously.
  2. We take measures to protect and secure your data through backups, redundancies, and encryption, as described in our Privacy Policy.
  3. When you use our Services, you entrust us with your data. You agree that we may process your data as described in our Privacy Policy and for no other purpose. We may access your data:
    • To help you with support requests you make.
    • To operate, maintain, and improve the Services, including fixing errors that stop automated processing.
    • To safeguard the Services. We may look at logs and metadata to ensure the security of your data and the Services as a whole.
    • To the extent required by applicable law.
  4. We use third-party subprocessors to run the Services; the list is in our Privacy Policy.

Content ownership and AI-generated output

  1. All content you upload to the Services must comply with applicable copyright law. You retain whatever rights you hold in the content you upload; we claim no ownership over it. You give us a limited license to store and process your uploads solely to provide the Services to you.
  2. Summaries and other reading aids are generated automatically by AI from the content you upload. They are provided for your personal use. AI-generated output can be inaccurate or incomplete; do not rely on it as a substitute for the underlying article, and verify anything important against the original source.
  3. The Company or its licensors own all right, title, and interest in and to the Services themselves, including all intellectual property rights therein. You may not duplicate, copy, or reuse any portion of the code or visual design elements without express written permission.

Features and bugs

We design our Services with care, but there is no such thing as software that pleases everybody, and as with any software, our Services inevitably have some bugs. We make no guarantees that our Services will meet your specific requirements or expectations, and we don't guarantee completely error-free Services.

Liability

We mention liability throughout these Terms, but to put it all in one section:

You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the Services; (iv) or any other matter relating to these Terms or the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.

In other words: choosing to use our Services means you are making a bet on us. We do our best to be a safe bet.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
